1. Acceptance
By accessing or using Execenta you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the service.
2. Service description
Execenta provides a revenue and commerce intelligence platform, including dashboards, connectors to third-party systems (e.g. Shopify, Salesforce), and related features. We reserve the right to modify or discontinue features with reasonable notice where practicable.
3. Your obligations
You must use the service in compliance with applicable law, not misuse or attempt to gain unauthorized access, and comply with the terms of any connected platforms. You are responsible for maintaining the confidentiality of your account credentials.
4. Payment and subscription
Fees and billing terms are as described on the pricing page or in your order. Payment is due as specified. We may suspend access for non-payment after notice.
5. Limitation of liability
To the maximum extent permitted by applicable law, Execenta and its affiliates, and their respective suppliers and licensors, shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of profits, data, or business opportunity) arising out of or in connection with the service or these terms, even if advised of the possibility of such damages. Except where prohibited by law, our total aggregate liability for any claims arising from or relating to the service or these terms shall not exceed the amount you paid us for the service in the twelve (12) months preceding the claim. Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other matter that cannot be excluded or limited under applicable law.
6. Governing law and disputes
These terms are governed by the laws of the Netherlands, without regard to conflict-of-law principles. Any dispute arising from or relating to these terms or the service shall be subject to the exclusive jurisdiction of the courts of Amsterdam, the Netherlands. You may also bring claims under mandatory consumer protection laws in your country of residence.
